This Product Use, Warranty, and Application Disclaimer (“Disclaimer”) governs the use of all Maxxseal LLC (“Maxxseal”) products and supplements any product literature, technical data sheets, safety data sheets, installation guides and other materials provided by Maxxseal. By purchasing, using or applying any Maxxseal product, the user acknowledges and agrees to the terms set forth herein.

Maxxseal products are intended for professional and knowledgeable users familiar with industry-standard application practices, substrate preparation requirements and job-site safety procedures. The user is solely responsible for determining the suitability of any Maxxseal product for a particular application, surface or condition. Maxxseal makes no representations or warranties regarding compatibility with any specific substrate, material or system unless expressly stated in official written documentation.

Application conditions, surface preparation, environmental factors, workmanship and installation methods are beyond the control of Maxxseal and directly affect product performance. As a result, Maxxseal cannot guarantee results and expressly disclaims responsibility for failures resulting from improper surface preparation, incorrect application, contamination, environmental exposure, structural movement or use outside recommended guidelines.

All technical information, product recommendations and application guidance provided by Maxxseal, whether written, verbal or published online, are offered in good faith but are provided for general informational purposes only. Such information does not constitute a warranty, guarantee or binding representation of performance and shall not be relied upon as a substitute for professional judgment, job-site testing or verification.

Any warranties applicable to Maxxseal products are limited solely to those expressly provided in written warranty documentation issued by Maxxseal. No implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose, are made or intended unless required by applicable law and cannot be disclaimed.

To the fullest extent permitted by law, Maxxseal LLC shall not be liable for any direct, indirect, incidental, consequential, special or punitive damages arising from or related to the use, misuse or inability to use any Maxxseal product. This includes, without limitation, damages for property loss, labor costs, rework, downtime, lost profits or business interruption, regardless of whether Maxxseal has been advised of the possibility of such damages.

Users agree to assume all risks associated with the handling, storage, application and use of Maxxseal products. The user further agrees to indemnify, defend and hold harmless Maxxseal LLC, its owners, officers, employees, agents and affiliates from and against any claims, damages, liabilities, costs or expenses arising out of or related to the use or application of Maxxseal products.

This Disclaimer shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any dispute arising from or relating to the use of Maxxseal products shall be resolved exclusively in the state or federal courts located within the State of Washington.

Maxxseal reserves the right to revise or update this Disclaimer at any time without prior notice. Continued use of Maxxseal products constitutes acceptance of any revised terms.
